CCTV at Bay Venues

Bay Venues (a Council Controlled Organisation) owns and manages a network of CCTV security cameras operating in and around our venues. These cameras operate continuously and capture video footage.

COLLECTION PURPOSE

Bay Venues uses CCTV for safety and security purposes: to monitor and respond to health and safety situations; to deter and detect criminal activity; to support investigation and prosecution of criminal offences; and to provide evidence to the Police, courts, tribunals or public sector agencies where required to uphold the law. 

STORAGE AND RETENTION

All CCTV footage is stored securely. Access to footage is restricted to authorised staff and public law enforcement agencies (e.g. NZ Police), and only when required for a purpose noted above, or to verify the system is operational. CCTV footage is routinely deleted after 60 days unless it has been flagged in connection with an incident, complaint or legal matter, in which case it is retained only for as long as necessary to resolve that matter. 

USE OF FOOTAGE

No attempt will be made to identify individuals from CCTV footage, except in cases of reported or suspected incidents requiring investigation, or in relation to any legal proceedings. Bay Venues takes the privacy of individuals seriously and will ensure the operation of its CCTV will be conducted responsibly and for a lawful purpose, avoiding any inappropriate, intrusive or unlawful use of the CCTV and the footage collected. 

ACCESS AND CORRECTION RIGHTS

You have the right to request access to any CCTV footage in which you appear, and to request correction of that information if it is wrong, misleading or incomplete. To make a request, contact our Privacy Officer using the details above. We will respond to your request in accordance with the Privacy Act 2020. In some circumstances access may be declined, for example where releasing footage would prejudice an ongoing investigation or the privacy of another individual. 

LEGAL FRAMEWORK

CCTV and any footage collected will be managed in accordance with our CCTV Policy, the Privacy Act 2020, the Public Records Act 2005 and the Local Government Official Information and Meetings Act 1987.
